Gay Florida couple wins right to adopt

A gay couple from Miami Florida has officially adopted their two foster children on Wednesday. The couple were assisted by the American Civil Liberties Union in a lawsuit filed against the state.

Florida’s ban on gay and lesbian adoptions was declared unconstitutional by a federal court, the 3rd District Court of Appeal, in a ruling last year. The state of Florida did not appeal.

Because the ban was declared unconstitutional by a federal court, the impactions of the decision are likely to affect other states.

Vermont permits unmarried couples to adopt simultaneously, and also allows co-parent adoptions (non-simultaneous) by same sex couples. There is no mention of surrogacy under Vermont law.

Other states that allow unmarried couples to adopt include California, Connecticut, Illinois, Indiana, Masachusetts, New Jersey, Oregon, and Washington D.C.
